Corporate investigations in the construction and real estate industry

Both the construction industry and the real estate industry are economic sectors with high risk potential: agreements that restrict competition, money laundering, bribery and other prohibited acts are absolute “no-go’s” for market participants who comply with the rules. But “greenwashing” can also become a criminal problem for the entire company due to the Association Responsibility Act. Competitive pressure and adverse market conditions contribute to the fact that legally frowned upon behavior can unfortunately sometimes take place.

Taking precautions against the illegal has absolute priority. But what to do if it turns out that the porcelain is broken, the exact extent of the damage that has occurred and the responsibility and the correct handling of the situation can be determined? In our workshop we deal with the questions:

Sowohl die Bauwirtschaft wie auch die Immobilienwirtschaft sind Wirtschaftssektoren mit hohen Risikopotentialen: Wettbewerbsbeschränkende Absprachen, Geldwäsche, Bestechung und andere verbotene Handlungen sind absolute “no-go’s” für regelkonforme Marktteilnehmer. Aber auch “Greenwashing” kann aufgrund des Verbandsverantwortlichkeitsgesetzes zum strafrechtlichen Problem für das ganze Unternehmen werden.

Wettbewerbsdruck und widrige Marktumstände tragen dazu bei, dass rechtlich verpönte Verhaltensweisen leider manchmal doch stattfinden können. Gegen Unerlaubtes vorzusorgen hat absolute Priorität. Was aber tun, wenn sich zeigt, dass das Porzellan zerschlagen ist, der genaue Umfang des eingetretenen Schadens und der Verantwortlichkeit und der korrekte Umgang mit der Situation festzustellen ist?
