Corrigendum deed for GDPR
Kindly be informed that over the past days a Corrigendum Deed amending several provisions of EU Regulation No. 2016/679 on the protection of individual rights with regard to the processing of personal data Directive no. 95/46/GDPR was published on the European Union Council’s website. The corrigendum refers to all GDPR versions translated in EU members states’ official languages and is due to enter the European Parliament’s agenda for approval, with national authorities having the possibility to have a say on the amendments.
This is a really important matter to be considered by data controllers in Romania, considering that the clarifications made also implement correction of errors which previously affected the substance of the GDPR provisions.
Among the most important amendments proposed to be rendered to the Romanian version of GDPR, we underline the following:
Regarding the right to object of the data subject, granted by Article 21 GDPR, on page 45 GDPR – Romanian version, it was clarified that data subject has the right to object, on grounds relating to his or her particular situation, at any time to processing of personal data concerning him or her which is based only on point (e) or (f) of Article 6(1) as, in the actual form of the deed, it is suggested that the data subject may have the right to object in any data processing operation based on Article 6(1).
At the same time, on a different note, as per the content of article 31) regarding the Cooperation with the supervisory authority, on page 51) the initial text imposed the obligation of the controller and the processor and, where applicable, their representatives, to cooperate, on request, with the supervisory authority in the performance of their tasks, while the correct text refers to the cooperation of the data controller and data processor in order for the authority to be able to perform its own activities and competences, as provided by GDPR and the national legislation.
The Corrigendum Deed corrects as well other EU Official languages of GDPR versions.
