Photovoltaics on buildings is becoming more and more mandatory in order to meet sustainability requirements. Even large-volume retail and commercial properties can often be fitted with solar panels relatively easily. This gives rise to new legal questions:
- When is the construction of photovoltaic systems mandatory?
- Can development and installation costs be passed on to tenants/users of the property?
- Can the electricity generated by the PV system be sold to tenants/users?
- Do existing contracts have to be adjusted accordingly?
