Introduction

Critical information for power plant investors and developers: due to the armed conflict in Ukraine and the much broader energy crisis, the government of Hungary has amended the rules on available free grid connection capacities and the related individual procedures.

Published available grid connection capacities

On 09 August 2022, the government provided for a temporary different application of the Electricity Act and adopted the following new rules:

  • The network operators will publish detailed information on available free grid connection capacities and the technical and expected economic conditions for connection for the second time by 31 January 2023.
  • The deadline for issuing the call for technical and economic information and the feasibility study for connection applications submitted in the so-called individual procedures launched after the publication of the detailed information for the first time on 2 May 2022 is, by way of derogation from the provisions of the sectoral codes, 2 November 2022.

The rules entered into force on 10 August 2022 and are expected to remain in force until the end of the conflict in neighboring Ukraine. The new rules will also apply to pending procedures, with the exception that, in the interests of security of the electricity system and continued security of supply, the content of the technical economic information and the call for feasibility studies will be determined in accordance with the legal and electricity supply regulations in force at the time of their issuance.

Változások a szabad hálózati kapacitásokra vonatkozó szabályokban– mire számíthatnak a fejlesztők?

Bevezetés

Az ukrajnai fegyveres konfliktus és a sokkal szélesebb körű energiakrízis miatt Magyarország kormánya módosította az elérhető szabad hálózati csatlakozási kapacitásokra, valamint az ehhez kapcsolódó egyedi eljárásokra vonatkozó szabályokat.

Közzétételi kapacitások

A kormány augusztus 9-én este a villamosenergia-törvény ideiglenes eltérő alkalmazásáról rendelkezett, így az alábbi új szabályokat fogadta el:

  • A hálózati engedélyesek az aktuális szabad kapacitásokról és a csatlakozás műszaki és várható gazdasági feltételeiről szóló részletes tájékoztatót másodszorra 2023. január 31-éig teszik közzé.
  • Az először 2022. május 2-án közzétett, az aktuális szabad kapacitásokról és a csatlakozás műszaki és várható gazdasági feltételeiről szóló részletes tájékoztató közzétételét követően indult egyedi eljárásban benyújtott csatlakozási igénybejelentésre vonatkozó, az üzemi és elosztói szabályzatban meghatározott műszaki gazdasági tájékoztató és megvalósíthatósági tanulmány készítésére vonatkozó felhívás kiadásának határideje – az üzemi és elosztói szabályzattól eltérően – 2022. november 2. napja.

A szabályok augusztus 10-én léptek hatályba, és várhatóan a szomszédos Ukrajnában zajló konfliktus végéig hatályban maradnak. Az új szabályok a folyamatban lévő eljárásokra is vonatkoznak, azzal a kivétellel, hogy a villamosenergia-rendszer biztonsága és a folyamatos ellátásbiztonság érdekében a műszaki-gazdasági tájékoztatók tartalmát és a megvalósíthatósági tanulmányokra vonatkozó felhívást a kibocsátásuk időpontjában hatályos jogszabályi és villamosenergia-ellátási előírásoknak megfelelően határozzák meg.
