Warranty and Indemnity (“W&I”) Insurance has become a really hot topic also for real estate transactions: To insure a transaction can not only take the heat out of usually very controversial negotiation points – it can substantially speed up the process, improve the quality of due diligence and information, and provide comfort that warranty claims, if any, will be handled professionally and without emotion.
In addition, insurance premiums have decreased over the years. The number of insurers prepared to take the risk has grown. The transaction volume for which it is economically feasible to insure a deal is now substantially lower. It only takes few days to obtain an indicative offer for a deal.
However, specialised know-how is required to really understand the product, to see how it works, and to also tailor the due diligence and the sale and purchase agreement to make it suitable for W & I insurance.

Peter Oberlechner
Peter is a partner of the Real Estate Team of Wolf Theiss, and one of Austria’s leading transactional lawyers. He has e.g. orchestrated the acquisition of Vienna’s “Millennium Tower” by ArtInvest, or the sale of a 45% stake in the Shopping City Süd by Unibail Rodamco Westfield.
